    Traffic Ticket Question

Paging the top legal minds on TGR...

I received a ticket yesterday for making a right turn at a stop sign without coming to a complete stop.

If you look at this particular 4 way intersection on a map, the upper right quadrant of the intersection (12-3 o'clock) is Town X. The lower left quadrant (6-9 o'clock) is town Y. The cop who gave me the ticket is from Town X. I committed the crime in Town Y, never entered Town X in the process and was pulled over in Town Y.

Can he do this and why?

This isn't the wild west where you just have to make it over the state line. There is probably a jurisdictional agreement or perhaps a state law. I doubt the cop only had the power to ticket you based upon your quadrant.

Most likely, that is his spot, because law breakers like yourself.

I bet he knows what he is doing.

Danno, based on the above since this traffic offense was committed 25' away from his jurisdiction and he can pull me over and issue a citation, what's to prevent him from doing so at 100', or 1000' feet away from his jurisdiction?

Shouldn't the fine be paid to the municipality and the case heard in the court of the town this crime was committed in?

We're talking $100 of beer money here, so it's nothing to sneeze at.

    Top legal advice?

    Very short answer: yes.

Want a longer answer? $300/hour sucker.

    Where's Big Steve?

I'll take all legal opinions on this case, but I'd prefer if you graduated from at least UPenn or higher.

It's me vs. a donut eating cop and small town prosecuter. I have the maps.

If it's any consolation I challenged a carpool fine, couldn't be bothered to go to court myself, figured it was money down the tube, then got a $345 check in the mail so I guess he never showed, and I ... won? So maybe challenge and don't go?

As Danno mentioned, the local governments probably have an agreement in place. If you gave us, you know, actual information, we might be able to Google that for you.

Call the town Y clerk's office and see if they have reciprocity with town X for traffic enforcement.

There also could be a state law and state standards for law enforcement that are in play here. Unless you're in the deep south.

Thanks. This is the best answer yet, and Peruvian is a chicken farmer. I will call later today.

A collorary qustion to the great legal minds of TGR. How do you force the police to turn over dash-cam video before trial ?

I guess about 2.5 years ago, I got popped for failure to stop at an intersection on my daily commute. Pissed me off royally. it was at a stop sign maybe 4 cars deep when I got to it, and "stop and go." I went to court and tried arguing that I had come to a complete stop many times in the "line up" and was compliant and the cop just laughed, produced dash-cam video showing that I sorta rolled through, following the car in front at the "final line."

Just for laughs you should find "official" city boundary to make sure you're not mistaken about your theory but this also seems like a shitload if work for $100 fine

I was referencing the property value of all of downtown Londonderry.
