Given that you don't have any actual damages (other than disappointment), I'd say no.

While factually and jurisprudentially correct, you fail to grasp the Perpetual Victim Status that the OP wants to solidify by suing everyone and everything for minor mistakes. I heard he tried to sue McDonalds because of how they spell ketchup, which OP insists must be catsup.

I sold my last place real quick with a great agent in a sellers market at the market peak just before the sky fell in and prices dropped and it became a saturated buyers market , it was my feeling if I had gone FSBO it would have taken time to do, it would be a real hassle from 400 kms away and I would have been riding the market down ...very stressful I imagine.

Then I bought this place on a FSBO, it had taken buddy awhile to sell and he had to drop 10-12%

SO in general do sellers that go FSBO realize mo money from the sale of a house cuz they don't pay a RE person

OR do the sellers tend to just not get as high a price because they possibly missed a market upswing/downswing/priced too high/ priced too low but because they didn't give any $$$ to an RE guy ... their perception is that they saved money?

depends on the market & timing eh? My friends ended up with ~$12k more in their pocket selling via FSBO, but they didn't have to try match market swings. You obviously made the right call. Regardless of what the market is doing, if you don't live nearby trying to sell FSBO will always be a hassle IMO & probably not worth it.
