Now, dunfreelegaladvice seems to be implying that a private website owner, with no knowledge of any facts of the situation, and not hosting any illegal image could somehow in anyway be potentially liable for the picture subject's claimed damages to reputation or for intentional infliction of emotional harm is ludicrous without an overt act of extortion towards the subject of the image with demonstrable knowledge of the lack of consent.

Do a little research on revenge porn laws that barely barely even provide a cause of action against the poster. 3rd party liability is ridiculous proposition given the facts of this hypo (what is more ridiculous is the actual facts, but that is just another spun out version of reality of the OP).

I think mtngirl79 should calm her tits or find somewhere else to prosthelytize, or at the very minimum, cease all non-skiing related posting, which would be equally as effective.

Secondly, posting one's opinion about the level of quality of a widget on a privately owned forum is just that; TGR is free to delete anything is so chooses either way.

And on the thread subject, I don't see how consent can or can't be proven for any photo, it's simply not workable. The rule certainly has to be no nude photos without subject consent, but proving it isn't posted with consent is virtually impossible.
