This happens all the time in the business world. Backcountry would probably lose if they went to trial, because the term "Backcountry" is a commonly used descriptor, and therefore a "weak mark" (very difficult to obtain an exclusive right to a descriptive trademark) but the little mom and pops can't fund their defense of use of that same descriptive trademark. In the end, Backcountry will probably wind up paying the mom and pops to switch names. If you really want to fuck with them, start a crowdfunded defense fund. Backcountry will not go to trial if they think they may lose, because it would eliminate the value of their investment in the trademark entirely. A well funded defendant with a long running use of the mark is a perfect case to defeat Backcountry's strategy.

Except BC hardly ever has the best deals. They're like Amazon, You can get anything you want but you're going to pay the going rate for it.

That tyrant dude said that choice line. "L'etat c'est moi" and all that. Kinda like the current resident of 1600 Pennsylvania Ave.
But I digress. Really disappointed that BC.com would do this. That sucks. I blame private equity! And greed. And shitty lawyers.

Immediately got this response:
Backcountry.com is currently engaged in a legal matter with Snapperhead Inventions LLC, the producer of the Marquette backcountry ski, related to the use of the our (Backcountry) name on their ski. We decline to comment on the matter until such time as it has been concluded, but we respect the rights of our customers and the public at large to discuss the matter and have their own views on it. While we would be really disappointed to lose any customers over the matter, we appreciate that people may feel strongly about it and chose to shop elsewhere.

Will I need to pay royalties to Backcountry.com when I recreate in the backcountry going forward? Am I allowed to buy a ski for use in the backcountry? Can I refer to the activities that I do in the outdoors away from populated areas as backcountry, or does the backcountry.com legal team have an alternate word for the entire industry to use now?
I hear the Forest Service has backcountry rangers - will they need to pay Backcountry.com for us of that title in the future?
There's a small café in Mazama Washington has the likeness of a goat on stickers, hats, t-shirts and mugs. Have for 25 years. They should sue them next, since they're the in business of having no soul.
