    Should I sign this release to be in a Warren Miller film?

    So I just got an email from a guy at Warren Miller letting me know that they are going to be filming at this years X-Games and focusing on the Monoskier-X competition I'm competing in. Apparently they're going to be doing quite a bit and following us through training and the elimination rounds plus the televised final itself to be featured in 'next years film'.

    Sounds pretty cool, obviously I'd prefer to be in a TGR film *cough* *cough*

    They've asked me to sign a waiver, which looks like I basically sign my life away completely:

    You hereby grant Producer, its successors, assigns, distributors, licensees and affiliates the unlimited and
    irrevocable permission to use your name, likeness, image, voice, biography, interview and performance
    (“Likeness”) in connection with or as part of the program entitled
    “_____________________________________” and any spin-off, sequels, TV series, corporate films, stock
    footage, television commercials and/or any other use desired by producer (the “Picture”) in any and all
    manner and media now in existence and/or hereafter developed, throughout the world, in perpetuity. Your
    participation in the Picture may be edited in Producer’s sole discretion. Without limiting the generality of
    the foregoing, Producer may use, and may license others to use, your Likeness in and in connection with
    the Picture and Producer’s business, all advertising and publicity therefore and ancillary and subsidiary
    uses thereof, including merchandising and commercial tie-ins. Producer shall have no obligation to use any
    of the rights granted herein.

    You hereby acknowledge that you have no right, title or interest of any kind or nature whatsoever in or to
    the Picture, and that Producer shall be the sole and exclusive owner of the Picture and all of the proceeds
    and result of your services.

    You hereby acknowledge that your participation in the Picture pose a risk of personal injury. You
    represent and warrant that you are in good physical condition and have health insurance and you hereby
    assume full responsibility for all risks which may be associated with, and all injuries which may occur to
    you in connection with, your participation in the Picture. You, on behalf of yourself, your heirs, assigns,
    executors and administrators, hereby release and hold harmless Producer, its affiliates, and each of their
    respective officers, directors, agents, employees, representatives and assigns, from and against any and all
    claims (including, without limitation, any claims for invasion of privacy, violation of the right of publicity,
    defamation, or for any fees in connection with the use of your Likeness as set forth herein), liabilities,
    injuries and accidents resulting from, or in any way connected with, your participation in the Picture.

    You represent and warrant that you have the right and authority to enter into this Agreement and that it is
    not necessary for Producer to pay any fees to any collective bargaining organization or other party in
    connection with your participation hereunder. You will indemnify and hold harmless Producer, its
    affiliates, and each of their respective officers, directors, agents, employees, representatives and assigns
    from and against all costs, damages and claims arising from any breach or alleged breach by you of any
    representation, warranty or agreement hereunder.

    Your rights and remedies in the event of any breach of hereunder by Producer shall be limited to the right,
    if any, to recover money damages in an action at law, and in no event shall you be entitled by reason of any
    such breach to terminate this Agreement or to seek any equitable remedy. This Agreement shall be
    construed in accordance with the laws of the State of Colorado.

    Is this normal, should I just STFU being a JONG and sign it so I can be in a ski porno?

    Yeh definitely...then see if you can get change for a nickel on tape in a warren miller movie somehow! Either way why not enjoy your 15 minutes...just remember to stomp it!

    take your opportunities as they come, assuming its something that you enjoy and want to do.

    put a huge FKNA sticker on your sitski and your helmet. it you get interviewed, ask the interviewer for "change for a nickel."

    i didn't actually read all of the waiver, but the lawyers i know say it is not possible to sign your life away. if you die, and someone else is at fault, they can be made to pay.

    it basically says that anything they film of you is theirs and they don't have to pay you for it, ever.

    I figured I'd pretty much have no choice but to sign it. There's 9 other skiers in the event and they'd just use footage of them instead of me, only way I could have any bargaining power is if I knew I was going to win and held out until then, risky!

    I have FKNA on my helmet, I'll be slapping it wherever I can and trying to get in a 'change for a nickel'. They'll probably edit it out think I'm just a bumb brit who hasn't got used to the money yet.

    Nah, this time last year maybe. I was living like a rock star with the exchange rate. The pound is tanking now though, but it's still cheaper to bum around the USA than skiing in europe.

    Last time I went home to England I was smart enough, when getting change for 5, to ask for it in coins.

    WM films take a lot of crap around here, but I'd jump at the chance to be in one in a hot second if I were good enough.

    I'd never sign that ridiculous release though. If WME can't scrounge up even a few hundred dollars to throw your way for participating, tell them to suck it.

    We had to sign warren miller releases at the Jeep King of the Mountain/48straight in sun valley last year, no big deal. They'll probably just use a tidbit or small clip in next years film, maybe...

    You're talking about probably a minute or two of screen time, total, and were going to do the comp even before WM contacted you... Have you been in, and gotten paid to be in, movies before? I would look at this as a great opportunity to get your name out there. Be super nice and cooperative with the WM people so that when they need a specific person for a sitski segment in the future they will think of you, then ask for some money.

    Does TGR, MSP, et al pay their athletes? Or just some travel expenses? I know that lesser rock stars often have to pay their way to AK, BC, where ever and then they try to recoup some money from sponsors after the fact.

    Sweet, thats what I wanted to check up on. I wasn't expecting to get paid, I'm stoked to just have the possibility of being in the background, of a pan shot, for a second, of a WM film.

    Most every release form you will ever come across will read as if your life is being sucked away by the producers. Just legal BS jargon to make some executive feel less paranoid about getting his G5 taken away from some frivolous lawsuit... I wouldn't doubt it if you already have signed or will sign a release for ESPN as well, which WM is very likely covered by.

    Yeah, monoskiing always gets confused with..........er, monoskiing, the other kind. I dont know why they dont call it SitSkier-X instead so it's more obvious.

    Most people in a sitski ski on a single ski, hence the monoski confusion. The bi ski set-ups are generally used for people with more severe disabilities that leave them with less core stability control and balance.

    DONT sign it, as an actor, I can tell you NEVER SIGN anything, you dont get paid for, unless you volunteer., but you know a big comapny WANT to film you, they come to you, THEY PAY, period.
    OR sign it with a fake sig, then later they say "we have your sig!" NO you dont!
    Because most likely they will not be able to film around you and then they cant publish the footage, unless you work out an agreement on your terms IE GET PAID.
    dont be another dumb athlete selling his soul for 5 sec of fame.


    Look at the moron at vail... He GAVE that photo away... if he would have sold it, theres a good chance hed have gotten $5k-30k(long term)

    and Warren miller, isnt some broke company trying to make a film, they have money. Its unfortunate that in the film industry, especially sports, no one gets paid but the producers. they are going to make money off you, dont you deserve a piece?
