Smells like something something
Spencer Elden, who appeared as a naked baby on one of rock music’s most iconic album covers – Nevermind by Nirvana – is suing the band, claiming he was sexually exploited as a child.
In a lawsuit filed in a Californian district court against numerous parties, including the surviving members of the band, Kurt Cobain’s widow Courtney Love, and the record labels that released or distributed the album in the last three decades, Elden alleges the defendants produced child pornography with the image, which features him swimming naked towards a dollar bill with his genitalia visible.

150k?!?!? That’s wut I read he’s asking for. Seriously I said it in the other thread where this was brought up but just fucking pay the person. The law firm that Any of defendants would hire can burn that in a fucking day.

sounded to me like no permission and no payment. $150K seems pretty cheap to me....how much that album make? My guess enough to buy a shotgun at least.

08-25-2021, 01:19 PM #10Elden is seeking damages of at least $150,000 from each of the 15 defendants, plus costs, and asks that the case be tried with a jury. The defendants have not yet responded to the lawsuit, or commented on it publicly. The Guardian has contacted Elden, his lawyer, and the managers of the Nirvana estate for further comment.

The same guy recreated the album cover just five years ago. He didn't seem to have much of a problem at that time:

He also posed for the album's 10th, 17th, and 20th anniversaries. So after 30 years it looks like he's still trying to catch that dollar...

I guess that my question is was that image ever used, sold, displayed, etc. as art. Did that actual image generate revenue ($$$) on its own, regardless of the crappy music it's associated with?
Consider that college athletes, in some states, are now able to receive recompense for their names and likeness's being used on clothing and in on-line games, and maybe other shit.
There's now a precedent, and perhaps that is why "Naked Baby " is finally seeking legal remedy for the original image.

Spencer is now an artist living in LA.
His parents were paid £154 for the original shoot and he was paid the same amount earlier this month for the recreation.
The original photo was taken by Kirk Weddle, a friend of Spencer's dad.
The new picture is taken by British photographer John Chapple in the same California pool as the original.
