The Notorious. I hope she realized how much she meant to the world. What a contribution. Thank you.

Is filibuster an option in this scenario?

Filibuster was eliminated a while back for court appointments. We're well and truly fucked here.
Personally, if Biden wins and the Senate turns blue, I'll advocate for eliminating the filibuster in all cases (so that we can actually have majority rule and get some shit accomplished), and for adding some more members to the Court. There is no constitutional reason there next Pres can't appoint 4 more justices.ride bikes, climb, ski, travel, cook, work to fund former, repeat.

Yep.
As pointed out, that approach accomplishes nothing with how our Constitution is written.
Yep as well.
She represented a time when political and ideological odds could get on and enjoy each others’ company and discourse. She had a well-known personal friendship with Justice Scalia that I doubt we will ever see the likes of again.
She clearly put Country first.

A slim ray of hope:
Sen. Susan Collins
Sen. Chuck Grassley
Sen. Lisa Murkowski
Sen. Mitt Romney
Have all committed to not voting on a New SCOTUS Justice until after 20 January 2021
That leaves 49 Republican Senators, or less, standing alone.
No majority, no new #SCOTUS

Can’t wait to hear Barr gloating about this.

Grassley did say 'something' like that but he rules from a purple state. He throws bones to the centrist Dems and Indy's that swing the vote here but when push comes to shove he is a shameful hypocrite like the rest of the Republicans.

As unlikely as that is (judicial code of conduct that the courtroom jocks here can opine on better than I could as I haven’t read word 1 about that since passing the multi state professional responsibility exam) it does nothing to prevent the Senate and Executive Branches from exercising their Constitutional powers to nominate and confirm a candidate.
Not that I think either of those are proper at this time and given recent precedent, but it is in fact within their rights.I still call it The Jake.

Agree. I think there is going to be political hellfire over this. The BLM movement may seem like small potatoes soon...realistically that is where I lay my hope. And that we can save this country somewhat peacefully.
Stay tuned and clutch your shotguns close. Some rough sailing ahead boys.
