    The restitution to Aspen is the amount of Aspen's deductible ($250k). It's in the article. Aspen isn't double dipping here, although that happens a lot.

    Here's how it works in basically every prosecutor's office in America. Some legal assistant opens the case and reads who the police listed as the "victim." Then the legal assistant sends the victim a Victim Impact Statement to fill in where the victim can say how much their loss is. Then, as part of the plea, the defendant must agree to pay the restitution listed in the victim impact statement. Aspen Co. presumably only put down their loss (their deductible) and not the entire loss. It is not illegal for the court to order the full restitution in a case like this, but just saying, it normally isn't the case.

    as “a result of the Defendants’ actions, (Skico), and thus National Union, suffered a loss in the principal amount of $5,212,484.”

    National Union’s lawsuit consists of counts of conversion, civil conspiracy and unjust enrichment against both Johnsons, and separate counts of fraud and breach of fiduciary duty fraud against Derek Johnson.

    Too familiar with Subrogation as after my drunk ass fell off the balcony at Ruthie's one summer at a wedding when I lived in SLC, people I knew still in the RFV kept asking me why I was "suing Aspen Mountain?"

    I wasn't, I was totally at fault, but my insurance did trying to prove SkiCo was somehow at fault for my injuries they had to cover.

    He didn't steal from the "super rich". He wasn't breaking into Aspen mega homes and taking jewelry and valuables, or carjacking Porsche SUVs. He embezzled and stole from a corporation that employs, I guess, many Aspenites and operates the ski area. Sheesh.

    I thought they owned a place in Burlingame (deed-restricted employee housing), but not sure how that works out with restitution. There were kids, school age if I remember. Presumably the wife stayed there parenting while he was in the pokey.

    Oh no, he was grabbing them before they even got mounted.. Mine were Elan M777s in a 192cm... The bright green 87mm under foot ones.. in the plastic for a hundred bucks shipped.

    Their deed restricted employee housing unit is on Juan St, a 3bd/2ba about one football field away from the bottom terminal of lift 1A. They still own it according to the Pitco Assessor, probably one of the best units in the entire APCHA inventory. There was a sale a few steps away from their place that went for $20MM a couple weeks ago.
