My guess is that POS sweatshop employer will claim they mailed the check already when the DOL starts asking them about it. Then they'll be unable to prove you cashed it and have to send it to you (again?).
Go that way really REALLY fast. If something gets in your way, TURN!

DOL will see thru their bs. They have ways to rapidly speed up the process. He won’t screw with them.
Only thing required from you is to provide the restauranteur his tip. I recommend dog shit on his car door handles

OP. in many states there is a daily penalty for failure to pay wages timely on exit - in Oregon is runs to double the earnings after 30 days
The interwebz can help you find the rules for your particular situation.
Employer can require employee to pick up final check rather than mail.

Only way I know that at least part of a final paycheck can be held in some states is if there is property or items that they provided to you as part of the employment that have not been returned. Then they can withhold the value of those items (such as computer, cell phone, tools, etc.) otherwise they need to be providing the pay in a timely basis. Whether they can have you pick it up in person or mail may differ by state laws also.
