How to light a fire under a car insurance claim.
So a friend had her car blasted by rocks/sludge from a contractor doing work on a deck directly above her car. $5-8k damage. Their insurance company is dragging their feet, not responding to calls, not agreeing with any estimates, basically not doing jack shit. It’s been a month. Any ideas on how to get some action? Small claims court? Sucks for her to have to fork over lawyer money on something clearly the fault of the contractor. Any ideas? Thanks!

I recently was in a not at fault accident and I found that my repair shop was far more useful for dealing with the other insurance company than my insurance company was. YMMV.
Wouldn't this be a part of the contractor's liability insurance, not an auto insurance claim?

Not to hijack, but this is timely, I got into an accident almost 3 weeks ago that was entirely the other driver's fault, filed a claim through his insurance, and it's been crickets ever since. My car is drive-able, but I can't use the driver's side doors, which is inconvenient to say the least.
The insurance company I filed a claim through told me that I shouldn't even get estimates until they have finished their investigation. Never dealt with an insurance claim of any kind before, so I'm looking for any/all advice.

In my recent not at fault accident the hold up was the insurance company receiving the accident report from the police. They claimed they requested it but I think they were full of shit. After waiting 3 weeks, I went to the PD, paid $7 for a copy, and emailed it to the insurance company. The claim was approved a few days later.

I'm no insurance expert, but won't your insurance only get involved if you have collision/comprehensive (comp for the op, collision for Glade)?

This was likely my fuckup, and I'm not trying to cast blame anywhere, but there is no police report. I called my car insurance provider as soon as the accident occurred, and they told me explicitly not to get the police involved if there were no injuries and I did not suspect the other driver was impaired, so I didn't bother calling them.
I suppose I may have screwed the pooch there, but I did ask them repeatedly if I should call the police and was emphatically told "no."
Both myself and the other driver have collision coverage, FTR.

The answer varies by state.
In CA you're best off filing a claim with your own insurance assuming you have comprehensive/collision, the body shop gets paid by them less your deductible--fast, then they go after the other guys insurance to pay your insurance company and your deductible--slow. Your insurance has to pay most of the bill, no matter who is at fault, so they have an incentive to go after the other insurer if their driver is at fault. If you go after the other guys insurance yourself they have no incentive to pay you. Plus, your insurance is less likely to low ball you than the other guys.
If you both have the same insurance, you're screwed--whatever happened you'll both be 50% at fault in most cases. In CA the police won't usually bother with minor accidents. You need witnesses, photos, or the nature of the accident speaks for itself (res ipsa loquitor--that's latin)--rear ender, they had a stop sign and you didn't, etc.
Anyone know what happens when you go to small claims court over something that the other person has insurance for? Does the other party's insurer get involved or do they just pay back their guy after he loses in court?

Take it into a repair shop that you trust now. Don't wait unless you are considering not ever doing the repair.
So this other guys insurance told you not to get the repairs done yet? They are obviously representing the other guy. IME even your own insurance company will give you the run around and they are working for your $$.
The repair guy is the one that has something to gain for getting the repair done and paid for. It is your right to pick the shop and use the estimate from the shop that you like. They can do their own estimate too but you need to get your own estimate. There is a good chance they will just use your guy's estimate in the end instead of paying for a second one.
I had a similar experience and I got the local shop talk to the insurance do the estimate and repair right away. Took the insurance company a couple months to finally follow through and finish the claim but at least my car was fixed. Insurance people did not care if my car was broken or not. Repair guy wanted my business so I don't know if he expected the claim to take so long or not but since he was the guy talking to the insurance company he fixed my car and let me drive it for a couple months before he got paid.
