    I assume Silverton has insurance, which would provide a defense and indemnity. The accident and the newspaper article sound like a standard negligence claim, which would be covered.

    I have no idea how much coverage a ski area typically carries.

    Or perhaps: the ski area is correct. The lady was responsible for her own injury, but fuck it, letís sue...it couldnít possibly be her responsibility. No one else has ever unloaded this lift without injury, so obviously itís the ski areas fault.


    These suits frequently lead to more regulation which, yes, impacts your freedom. All regulations do....some are worth the trade off and others arenít worth it at all.

    You can't possibly look at that photo of the lift and think this for a sightseer. Silverton is a rad idea run by assholes and morons.

    Iíve always had fun there. Iíd hate to see it go. Iím sure insurance will cover it but they are barely breaking even from what I remember so that could be the proverbial straw. It would be a shame.

    Thatís why I asked my original question. I honestly donít know what Colorado inspections look for or the requirements for passing.

    That unloading area doesnít look so great...but, the article suggests that State inspectors passed the lift 2x/yr since 2002.

    Should the area be responsible when area passed its safety inspection and the State approved the lift operation?
    It makes perfect sense...until you think about it.

    One would assume that they have rather expensive insurance, with quite a bit of coverage, considering the business they're in. But again, it's not in the article so I prefer to assume that they don't.

    We will see how it turns out. The idea that this is probably driven by the HI company is dead on.

    What little revenue that was derived by offering scenics will never offset what a bad idea that was.

    Silverton officially offered scenics ? News to me.

    This sucks for everyone involved.

    Wow. I'm amazed that they'd allow some lady to try and dismount that ramp. Its sketchy on skis/board.

    Why even let a non skier on that? That's stupid.

    That ramp is stupid. It would have taken $300 in wood and screws to make a better ramp with a rail on the side. Or shovel a big mound of dirt there, or something.

    No lawyer, but that looks negligent as fuck, and certainly will look that way to a non-skiing juror.
