Prevent Marijuana Diversion To Illegal Market
Concerning measures to stop diversion of legal marijuana to the illegal market.
SESSION: 2017 Regular Session
SUBJECT: Crimes, Corrections, & Enforcement
The bill places a cap on the number of plants that can be possessed or grown on a residential property at 16 plants unless a local jurisdiction permits possessing or growing more than 16 plants. The criminal penalties for violating the cultivation limit are:
A level 1 drug petty offense for a first offense if the offense involves more than twelve plants, punishable by a fine of up to one thousand dollars;
A level 4 drug felony for a second or subsequent offense if the offense involves more than twelve but not more than thirty plants; or
A level 3 drug felony for a second or subsequent offense if the offense involves more than thirty plants.
A medical marijuana patient or primary caregiver who cultivates more than 16 plants must cultivate the plants in compliance with applicable city, county, or city and county law.
The bill requires a patient or primary caregiver cultivating medical marijuana to comply with all local laws, regulations, and zoning requirements.Terje was right.

You may not give a fuck about the man, but the man now is going to give a fuck about you and they'll have the power and resources available to do it.
This law particularly changes the constitutional right in the state of Colorado from 99 plants to 12 in all residential zoning regardless of medical prescription, period. They've also allocated $3,000,000 a year for enforcement with up to $250,000 per jurisdiction to do so and make it a felony for anything over 18 plants. The boot-lickers with the money made that happen.
I'm guessing those hundred-dollar zips are going to go away. The wrist slapping without b$$t-licking may last for the first 12 months of enforcement and will be blown up by the media so that every Muffy and Buffy in the burbs will have "heightened awareness" and be able to do something about it when Jr gets a whiff of th3 cHroniCz. By all means though, swing for the fence. I'm just looking out for a mag and advising you to do it anywhere other than residential zoning.
