I would think a call to a service writer could work or a quick Google search. I have had awd cars forever and even on my 2016 i was told a 4/32nd difference was the most I should go to stay safe on not fucking up a transfer case. And ya, you would shave down the new tire. Tire rack does that for $25 I believe.

Thanks all. I was feeling like shit yesterday (got a Covid test and will likely learn I’m negative is about a week), and I was hoping for a simple place to find an answer. Feeling better today. It’s a 2006 matrix, which has a simple viscous coupler awd system. Ive been owned awd cars since 2003 including a legacy with same awd tech, but never had to deal with this before. I know some awd systems are more sensitive than others.
Doing a little research this morning: owners manual says nothing quantitative. I haven’t found more than speculation so far on the internet. Ill measure tread depths and call the Toyota service center.

If it's a viscous coupling I'd just play it safe and get it shaved or make sure they are close.
Open diffs like our 4R I wouldn't worry about it.

The tires new are 10/32” and the ones on the car are a hair deeper than 8/32”.

Makes sense that it’s mostly Subaru owners having problems. 2/32 tolerance
AudiAs published in their vehicle owner's manual, "rolling radius of all 4 tires must remain the same" or within 4/32-inch of each other in remaining tread depth.
PorscheCayenne within 30% of the other tire on the same axle's remaining treadwear.
NissanGT-R when replacing less than four (4) tires, each tire continuing in service must have at least 6/32 inch (5 mm) of remaining tread depth.
SubaruWithin 1/4-inch of tire circumference or about 2/32-inch of each other in remaining tread depth.

The other issue on this topic is all 4 tires should be the same make & model. My Cayenne was delivered to me with 3 different types of tires on it That and a few other issues lead me to believe the previous owner was fucking clueless and didn't love the car. If cars could feel, I know Frieda is happy.

A few drops of liquid Ivermectin in the diffs to protect the worm gears, run whatever tire size you want. Shit saved India, can definitely save an ancient Toyota.
