Another Jackass hit me the other day...
To be more specific, a driver plowed into my fiance with her 2 girls in the car. The driver is underinsured and the accident was 100% his fault. All three girls are fine but shaken up.
The car is totalled. Instead of waiting for his shitty insurance company to pay up, I have submitted a claim with GEICO and I am hoping to get reimbursed for car rental (I did not have that in my coverage) and the deductable I assume I will have to pay.
Times continue to be tight and I can't afford to NOT get reimbursed for rental or deductable. Also, my thoughts are that it is good that I file with GEICO as they will have to pay for the car, but with police report and witness statement in tow, they will fight the other insurance company for as much money as they can get. Also, I will fight to make sure I am reimbursed for my expenses. I have also lost quite a bit of productivity at work, I assume this is covered in my Basic Personal Injury Protection, "pays for 85% loss of income". I am new at this shit...I have been lucky to avoid asshats on the road up until this point so any constructive input is appreciated.

If you live in a state where fault is determined, I personally would rather go through the responsible parties insurance co. If your ins co can't reclaim that money you're on the hook for it and your rates may go up due to a claim. If you dont have time or live in a no fault state (i.e. no "fault" if no moving violation, ticket), then you've done the right thing.
you insurance company will get on the repairs right away, again, out of pocket expenses. I wouldnt expect that you'll get care rental expenses reimbursed from the responsible parties insurance, least dont bet on it especially if you go through YOUR policy to expedite the repairs.
Good luck...accidents suck, but since everyones ok, a car is just a "thing" and replaceable.

The more detail your fiance can provide to support the position that she is 100% innocent of fault for the accident, the easier it is for her insurer to pursue recovery and in the process, derivatively whack the at-fault driver. It would also help her in any future rate-adjustment haggles at the insurer's end. But you gotta know what shows she's not at fault vs what might show some fault, and for that you might need a legal thinker's input.

Beware that by filing with your insurance, they may use that as an excuse to raise your rates. Years ago, my family's policy got cancelled after we, in a one year period, submitted a windshield replacement and a bumper replacement. Then our car got hit by an uninsured driver in a parking lot and the agent recommended filing with our insurance first. Boom....cancelled and thrown 9into high risk pool and insurance cost tripled. Claimed that we had 3 claims in a year - regardless of cost. Could have been 3 $50 claims or 3 $20,000 claims...same result.
Insurance company pursued other driver, but not very well as she didn't pay. a year later my dad went thru the process (since insurance company did nothing) and got the state to take away her license....suddenly she made good on a payment plan with the insurance company.
But...bottom line....we indirectly paid the price for an accident that was 0% our fault.

Always be sure to over-insist that you felt you were not at fault.
I got t-boned in an intersection (totaling two full size pickups) when I know I had the green light. When they asked me whether or not I had the green, I said I was totally confident that I had it, and as sure about it as i could be, and that was taken as "I don't know". I was just being honest, because its hard to be absolutely 100% sure of something ever, especially soon after something traumatic happens. Moral of the story is to always say you were 100% sure you weren't at fault if you dont want your premiums to go way up.
Dude ended up suing me (my insurance company which happened to be the same as his), and claiming emotional damages or something.
Moral #2, never return to Louisiana.

As much as I used to hate lawyers (yeah, cliche), my lawyer saved my ass when I got T-Boned a few years ago. RAM 2500 ran a stop sign at 40mph, total'ed my little x-over. Some medical bills, a lot of missed work - I decided to let an experienced lawyer-friend take care of it, and he did. While I instructed him that I wasn't after suing the living shit out of the offender, I did want to be reimbursed for my losses. Lawyer recovered those along with this own fee and was totally worth the almost hassle-free process. If you're truly not at fault, any good accident lawyer will take your case.

Your policy will not reimburse you for your rental or lost work. If you didn't buy rental coverage, you can seek reimbursement from the other carrier directly but nit from geico.
Further BIP/PIP coverage is for reimbursement due to an injury, not property damage. You won't get your lost wages paid for dealing with this from either company.
BTW - I'm a claims adjuster.

I think a lot of this is state-dependent. My wife had a bad accident not her fault and our insurance took care of the repairs and got the other guy's insurance to cover their cost and the deductible. Rental car wasn't an issue because our body shop (we have a regular one, unfortunately) gave us one for free. Didn't raise our rates. When I wrecked a 4Runner the body shop gave me a rental for free even though the insurance wound up totaling it. But don't ever get hit by someone who has the same insurance as you--I guarantee you will be 50% at fault so the insurance doesn't have to pay anyone's deductible.

Just received word from my insurance company that the asshole that hit my fiance is claiming injuries, has retained a lawyer and is saying that she is responsible.
I don't need this shit.

How much liability coverage do you have vs your assets? The amount of liability coverage you can add for a few dollars is worth it imo.

Call Jake from State Farm. When my daughter rear ended a car in stop and go traffic, Jake gave me $1000 more than the trade in value for my totaled car and 3 years later when the other driver claimed injury (obvious lie) they tossed him some $ to go away. And my rates didn't go up. But that was in New York State where the AG's have always been pit bulls.
Let you insurance company handle it.A few people feel the rain. Most people just get wet.

I wouldn't expect the claim to be settled very fast, here companies have 90 days and when I got hit an out of province insurance company took every one of those 90 days to settle the claim even tho my car was hit while parked in a P-lot and 30 breakfasters seen the perp slide into my carLee Lau - xxx-er is the laziest Asian canuck I know
