    Exclamation Lying car dealership?: Problems buying a new car in CA and registering it in UT

    I'm looking to buy a semi-rare 2010 car (b/c of the color) from a big dealership in San Fran and have them ship it (at my expense) to Utah where I live and will register it.

    I got an internet quote that is a great price and I got the ball rolling with the internet sale manager earlier this week.

    Yesterday, I get a call that they can't sell it to me b/c "I'm financing it and I'm from out of state, due to the Red Flag rule." There are no identity-theft red flags here, so that was BS. I did research and explained why it was BS.

    This morning the story changes to "we can't sell it to you b/c we're concerned you won't be able to register it in Utah." When I offered to pay cash instead of financing, they said they could do that no problem because then I'd get the title right away.

    I called Subaru Finance's customer service line, they said that was no problem - they'd just need to send a permission letter to the UT DMV once the car was purchased and shipped to UT. Easy.

    They've had this car for a while, so I'm not sure why they're cock-blocking me at every opportunity. I have 25% of the car's price in cash as a down payment. I have tier 1 credit. I even have an existing loan with Subaru for our Outback XT. I'm clearly a legit buyer.

    Any ideas? What reasons could they possibly have for making this so difficult for me?

    They dont have the car at all or they want you to invest in flying out there so that ou're more invested that way they can mess around on the price.

    If you arrange your own financing and can prove your identity(have a valid d.l., state id, or passport) red flags don't apply.

    my guess is that the dealership's internet sales person quoted you a price that his/her salesmanager didn't agree with.

    They have to sell you this vehicle at the quoted price, plus any applicable taxes. They even have to eat the handling(it will still be on the buyer's order but it will be included in the quoted price unless they quoted you the price plus handling).

    just call and tell them that you are filing a complaint with the California Department of Motor Vehicles investigative division and they will hop to accordingly.

    i bought a jeep from colorado and shipped it to texas years ago and bought a jeep from florida last year and had it shipped to texas. the one in florida, i was not pre approved of anything. i walked into the showroom, went for a test drive(after having a local mechanic check it before i flew out there) and had them finance me then and there.

    i gotta go with the, they dont like the price you got from them story.

    you tell 'em you gotta price you expect them to stand by, youre getting your own financing and have it checked out however you want to. if they keep backing up, you hit em with the better bus beareau, the state offices business bereau and anything else you can come up with. unless you let them run your credit and they dont see you having the ability to afford it, theres no legit reason to be pulling that junk.

    if theyre going to act like used car salesmen, they should be treated accordingly.

    Just got approved for financing through Chase bank, which is what Subaru uses.

    Since you are taking the car along a path towards less ridiculousness, it shouldn't be an issue. I bought a car in Kentucky this spring and registered it in NY (doing it wrong, heading from less to more ridiculous) and it still worked just fine with no red flag bs bla blah blah. But I brought a check from my bank.

    gonehuckin and mr gyptian have it about right. If you have a written quote kick them in the balls and make them come through.

    This is only one of many little tricks car dealers have in their repertoire.

    I never dealt with Subie of America, but sometimes the national office will make the dealer come through.

    I agree it is a constitutional right for Americans to be assholes...its just too bad that so many take the opportunity...

    Edit: Shockingly, they have a potential customer coming over right this second to look at the car.

    You did sign up for one of the VIP clubs so that you dont have to hassle price right? And if its in stock, they have to sell it to you no haggle, 2% back of invoice.

    You have to be a member of those clubs for a few months before you can exercise that, plus I already had a better price (which I'm convinced is why they did everything they could to bail on it.)

    phUnk...if she quoted you a price...IN WRITING...and you accepted...IN WRITING...and your acceptance met any contingencies in their quote...contract. If all that is the case...tell them that if they don't sell you the car, you will make a huge stink with Subaru of America regional, report them to the Consumer Affairs and sue them.

    I bought a Suby in Auburn, CA and took delivery in Reno so I didn't have to pay sales tax. Dealership did it for free without any hassles (and I got a killer deal on the car..) My guess is they figured out they have a 'rare' car and want to sell locally at full price....

    She gave me a price in writing (highlighted in red, no less) and my next reply was (verbatim):

    ^^^Probably the best solution. I have rarely (ever?) found a deal so smoking hot that another dealer wouldn't match it. Then you have the satisfaction of calling her and giving an electronic kick in the cunt.

    What exactly are you looking for? Some of the southern California dealers seem to be pretty willing to deal. They are common around here, but not super hot since very of southern Californians ever see snow. I can make a few calls for you. Keys Subie in Van Nuys offered me a great deal on mine 3 years ago. I ended up buying locally since it wasn't worth the few extra dollars for the drive. (and to keep a few sales tax dollars locally.)

    I agree it is a constitutional right for Americans to be assholes...its just too bad that so many take the opportunity...

    You may be running into some problems due to the signing papers in another state situation. I'm a few years removed from doing loan verifications for a major auto finance company so the exact reasoning isn't coming to me at the moment but I know for a fact our company would not fund loans that were not signed for in the state the dealer was located in. Dealers and customers would frequently lie to us about this and we often had to do some digging to get to the truth, if we found out a contract was signed elsewhere we would return the funding packet and refuse the loan. I think the general reasoning was that since it was a vehicle contract for state A and was signed in state B the contract was basically meaningless and wouldn't hold up in court.

    The other dealership, the good one with the guy that seems to be a straight shooter? They do financed (by Subaru Of America/Chase Bank) car sales all the time. He's processing my app right now. *shrug*

    soa and chase are easy to get some killer deals through. 2.9 was pretty good a month ago. if you're looking at sti's or wrx's or even the limited edition sti in aspenwhite, they arent nearly as rare as you think as long as you're not in a hurry. I dont know what else would be rare or a rare color from subaru.. Im sure you've done your homework. If its socal, free place to stay and I know a really good dude (used to be the prez of campy) who works at one of the dealerships. good luck.

    STI in Lightning Red w/o the $2000 wheels or crappy Nav. There's maybe 3 new ones in this half the country. I'm currently talking to a "motivated seller" that has 4000 miles on his 2010 and lost his job. He's in Chicago, but what's a little 1400 miles road trip for a sweet-ass car?

    Thanks for the offer of place to stay, gonehuckin. CA charges sales tax if you pick up the car in-state, but won't charge sales tax if you get it delivered out of state. I need to find out if UT would honor a CA sales tax receipt or if they would double-pump me for sales tax when I register it at home in UT. Hopefully I'd only have to pay sales tax once, then my special lady friend and I fly out to San Fran, grab the car, meet up with some Maggots, then haul ass the 12 hours back home to UT. That'll cost about as much as shipping it, so why the hell not?

    as someone else said the lies with the financing. When the dealer hocks you with Subie credit (or whatever bank) they have to make sure the car gets properly registered (i.e. the lien gets recorded at the DMV) before the bank will fund the contract and pay the dealer for the car. Basically in between the actual delivery of the car and the receipt/approval of the contract by the bank the dealer has no car and no money. Assuming its a new car they have an MSO rather than a title and there's a place to write a lienholder's name at the bottom so theoretically you couldn't do an end run at the Utah DMV BUT a clever bastard could gin up a phony void affadavit and get the car reg'd with no security interest attached. This may explain their nervousness (as a finance manager i would sometimes put the kibosh on an out of state deal the overeager sales manager had agreed to)

    The other issue does deal with red flags (a federal statute governing identity theft) you have to be the one that signs the contract and they need to match your license with your face. Unless you sign in person they don't REALLY know who they are extending credit to and the bank may not take the contract, some finance companies will allow signing to occur at an offsite notary but that was rare in my experience.
