Point is. I was right about this all along. My reason for being pissed about this is what it does to people that are both victims of actual crimes. The abuse of our court system. Finally, the money wasted by the Eagle County and the 5th Judicial district on her whim.

If she's not blowing smoke then why, when push came to shove did she make the decision not to testify? Thus causing the prosecution to not only drop the case. But the judge to declare it a mistrial with prejudice. Merits of the trial in question??? a little.

It's very common for rape victims to not even report it because of shame or embarassment or potentially having their name dragged through the mud.

Sorry, man. I know you really do have some interesting and valid things to say sometimes. But coming in with guns blazing and stomping around really does invite some poo. We don't know what went on in there, so I for one would just as soon not jump to conclusions.

that is the goddamned issue. she waited 9 months to the day it happened, to decide not to testify. All the while dragging HIS name through the mud.

Cases are dismissed two ways. With prejudice means that it can't be refiled. W/out prejudice means it can be refiled up until the last date a charge can be filed. Here, a felony can be filed 3 yrs after the alleged event. Civil cases are different because of statute of lims and the possibility that the statute of lims was tolled... long story that you don't need to know. Bottom line, this won't be filed again as a criminal charge.

The EC DA's office. Didn't they actually arrest Kobe against the wishes of their own police force? Again, we don't know what happened, but deciding not to testify in a case that is a complete media circus and drawing even more attention to your general sluttiness (all while important disclosure rules are ignored by the courts) seems like a reasonable decision to me whether she was actually raped OR made it up.

I'm acquaintances with the DA and he loathed every minute of this. There was some pressure from the community to go after him. A tangible "I moved to Cordillera to get away from people like him" sentiment was kindof unspoken. this was until the evidence started to come out regarding not only her sexual history, but her actions around the event. Then the sentiment was settle or drop the case and get it off my news stands. quite a few businesses stopped putting the Summit/Vail Daily inside their stores because of what was on the front pages.
