Stupid accident
Out on our Sunday ride, nice little down hill section into a nice 50 yard uphill that you can stamp on when timed right. One of the guys that I have gotten to know from riding with this group comes flying past me, right at the bottom, then full on up, thinking to myself, where the f is this guy going? He looks like he is going to rear end a very good friend of mine. Last second he swerves and side swipes my buddy. Takes him right out. My friend is on the ground, hard. Ambulance has to bring him to the hospital. Fractured collar bone, 7 broken ribs, punctured lung, fractured hip and road rash. All because this guy was not paying attention. Be carefull out there. It happens in an instant.

Yeah he stopped, very apologetic. But it still irks me. It shouldn't have happened, but I guess thats why they call 'em accidents. Just found out that they are thinking no surgery, in particular the hip.... Looks like a wheel chair for a month+.

Well in the apologists defense, nobody knew at that time the laundry list of injuries. We knew he was banged up, but never thought to that extent. When he finds out, he better feel real, real bad.... Thanks for the vibes .... Doc says he should be good for winter 2012-13. Said his helmet probably saved his life as he knows it.

An accident is a tree branch falling on a parked car. That collision was caused by someone being a fucking asshole. I'm not lawyer-happy, but that guy owes for damages and lost wages. Its dangerous enough having to look out for cars on the road, let alone some tour de fucktard dipshit jacked up on starbucks and strava. /rant.

Your buddy may or may not be inclined towards litigation, but his insurance company may make that decision for him... If they do, the other dude is going to get owned. Caused a witnessed accident?
Sounds like a bad one - hope he heals up well!

^^This! Your buddy took some significant injuries, his medical expenses are going to be significant. If he has insurance, the insurance company is going to ask how he got injured, who was at fault. They will then pursue their losses. If he has no insurance and qualifies for Medicaid, the state will do the same. If he pays out of pocket, his bills are going to get so large, so fast, that he will have no real option but to shift those expenses to the person responsible for them.
Tort law at its most basic asks and answers the fundamental question "how do we make sure that the person who is 'responsible' for a loss ends up paying for it?"
