Since I've sold shit on amazon before I feel I have to clear up the fact that this is one of the most important and obvious things you have to agree to when you sell shit via amazon. If you are selling VIA AMAZON it is not a person-to-person sale hence all the rules and fees you have to pay and follow. That is what craigslist is for. If you had done it properly amazon would have made her send the CDs back at her own expense and it would have required about 30 seconds of effort on your part.
This is an epic fail. I still think you should go on Judge Judy, because that woman would tear you a new asshole and it would be excellent.I thought their offices would be strewn with bunny-fucking and condom dispensers, a veritable enchanted forest of cock shafts and twat mist. - JoeStrummer

Dog shit under the car handles. Why did I never think to do this? Way safer than my old method...I was the "dog shit in a paper bag on the front stoop, light it on fire, ring the doorbell and run" kind of guy.
Dollar sign that bitch.

Rather then being 'that guy' (you know, the one everyone in the office laughs at and feels sorry for because yelling at a CS rep makes their sorry life more satisfying), here is an idea. Ask to speak to her supervisor. If her supervisor sucks, ask to speak to her manager. Don't stop working your way up the chain until you get that 60$ refunded. It's not that difficult when you don't act like a child.

dude amazon will bend over backwards for about anyone. Last Christmas a ups trailer rolled on its way to the sort facility so we double shipped everything on that truck just to make sure that the packages would get there on time. usually they tell the customer to keep the extra free. so just complain a bunch to the CS and you'll probably get you money back

Sorry this happened to you Are. If you're going to lay into her though I'd focus on the main point here instead of the "hope you get raped thing." There's a lot better you can say. Something like:
"Hey, I'm just curious but were you always a THIEF or is this something new? When you were a child, were you raised in some kind of shitty dysfunctional home where your parents were too drunk or stupid to teach you right from wrong and STEALING was generally accepted? Or has STEALING only become okay since you were an adult? Also, I am curious how it feels to be a COMMON THIEF and STEAL from people.
Personally, I'd have a hard time looking in the mirror, looking people in the eye, knowing that I TOOK things the did not belong to me when others are dealing with me on good faith. Does it feel good to you now to own something you DIDN'T PAY for? You must be a generally lazy, manipulative, and disingenuous person. Do your "friends" know that you STEAL? How about your kids, if you have any? Would you want them to know?
All of this is just for my own curiosity. Because I think it's people like you that make this world a crappy place to live in. Lucky for us, good people outnumber people like you. So enjoy those records...that you don't "own" but rather "STOLE." And watch out for that karma, it's a bitch. Think of me when you get slapped by it, and you will. Sprite's POV is absolutely the only way you should go if you are unwilling to just drop it.
And while it sucks that this happened, and she is a thief, take some personal responsibility here. You agreed to these terms. And even if you were unaware, anyone who has ever read Gear Swap knows that all disputes are rooted in poor communication. The lesson is don't just ignore the communications that you don't like."fuck off you asshat gaper shit for brains fucktard wanker." - Jesus Christ

Another buyer scam to look out for and dealing with PayPal is the purchaser orders someting, has it expedited to a vacant address and then files a dispute with their credit card company (or it is a stolen card and the real owner files the dispute). PayPal pretends to 'look into it' and you send all the information showing tracking and delivery. The slime bag gets the goods and whoever the card is, is reimbursed and you never know why the dispute went in their favor. IE, it could have been a stolen credit card or it was the scammer's claiming it was stolen. Keep KY around for these little joys.

And even with Sprite's approach, the person has told you to not contact her again about the deal. You may still risk the wrath of Amazon and even the legal issues (check with your lawyer) if you continue to pursue and even remotely try and continue to recover the goods. Your ship has sailed when Amazon awarded her the refund and no demand to return the goods.

What? No. Amazon is just saying they aren't going to entertain the stupid bullshit that goes on due to lack of or poor communication. Stay on top of your shit or lose - they aren't going to risk their reputation because you're a fucking asshat.
Seems fair. It's their field, play by their fucking rules or stick to Craigslist.
Nothing fraudulent happened here.focus.

IIUC, there's no fraud here. Both buyer and seller agreed to certain conditions that would govern any transactions by participating in the Amazon Marketplace. Pursuant to those conditions, she "Won". She may be a thieving bitch on the karmic wheel, but unless she lied to Amazon about what happened (and it doesn't sound like she did), no fraud occurred.

I have not read through the Amazon Terms and Conditions or rules- but it could all be spelled out, but from the sounds of things- he had a chance to reply to the dispute, did not and then Amazon ruled in favor of the buyer due to a lack of reply and response to the dispute. Happens every day in courts of law if you fail to provide a defense. How hard would it be to reply to the request to return item due to another seller offering at a lower price? A simple, "she entered into a contract to purchase item at the listed price, I shipped said merchandise and fulfilled the order and request you do not allow her to play the price match game if now she can get it at a few dollars cheaper elsewhere."
He sent a request to have the buyer ship the merchandise back (and got shot down)- maybe it was his pissy attitude and tone, maybe the buyer feels entitled to keep the merchandise and not incur any more $ out of pocket expenses paying to ship the item back. Maybe if he had offered to issue a pickup of the package (at his expense), she would have agreed, THIS is all speculation of course, but she has asked to NOT be contacted again. What Amazon (or worst the legal issues of this depending on the state the contract is under) are then next step if he pursues this any more.
No different than any other dispute- Ebay or wherever third party sales take place, many times they want to keep buyers happy and rule against a person. Do I hope the seller learned a lesson, yes. Do I hope the buyer gets some karma for her I am going to keep the merchandise even though the funds were returned- yes.

Regardless of proper terminology, the logic behind Amazon being judge and jury and allowing someone to keep goods after being refunded (regardless of communications), ie, 'rationalizing' the theft/keeping goods escapes me.....much less isn't right, IMO. Even if it happens everyday, it's simply a sad state of affairs at a basic level.

That isn't what it is, though.
1. She bought shit off of Amazon. Amazon refunded her the money and told her to keep the goods.
2. OP sold shit on (to) Amazon. Amazon said "hey, to play here you have to follow these rules or you won't get paid." Dude didn't pay attention, didn't follow the rules, and didn't get paid.
The connection between 1 and 2 is kind of beside the point. If you returned your weber grill to Walmart and Walmart said "here's your refund, don't worry about the missing pieces" and then Weber contacted you and bitched you out and said "send me the fucking pieces" you'd tell them to go fuck themselves and then post about it on TGR. And you'd be right on. That's closer to what this is than friggin eBay or gear swap.focus.

Well...a little raw at the moment thanks to PayPal and currently seeing Amazon under the same light while mulling over re-opening our Amazon and/or eBay stores......none of this is encouraging from our perspective, on top of other costs, requirements and controls seen in the past. Amazon appears to be seller beware.
For all those in love with Amazon policies, they have great deals on knee pads......Best regards, Terry
