wow.

when reading the JJ thread, I was pretty sure that bigpetey was to blame...now I'm not so sure...Petey seems like he has tried to make this transaction work a few times and cito has been jerking him around on price, then wether to ship the skis or not....

I'm feeling similiar to Alta Andy. As for Bite Me I'm not here to create enemies just trying to decipher right from wrong. I've been ripped off before and it sucks, but these 2 need to work something out. Peace.

I think it's been shown that cito is incapable of doing that. Whether he's been scammed or not, I don't know. But his only response seems to be along the lines of "I was scammed, I don't need to explain myself, he's a thief, fuck all you guys." And anyone who so much as asks him questions about it is an asshole in his eyes, the only proper response for him is for us to back him up and say bigpetey is a lying thief.

cito and bigpetey, both of you have made huge mistakes up to this point in this deal gone bad, but that is all in the past. Just learn from them and keep moving.

What is important is to resolve the problem as quickly and as painlessly as possible.

cito, raising the price of gear after sending it is going to piss anybody off, no matter what the circumstances are. Will you take the original asking price on the clean skis? What about dropping the price on the skis that had damage you forgot to mention? Two easy yes or no answers please.

bigpetey, if a payment is not made (regardless of the reason) on merchandise you received, you must return the merchandise or continue to try and make good on payment. I know two checks lost in the mail is a little odd, but through your bank you can stop payment on the checks and keep moving in the direction of paying off the merchandise. The other option is to just send the skis back. If cito refuses them, and they return to you, I would consider them a gift from cito (cito, you reading this?). Just make sure to keep all records. If you ship the skis, you will eat the shipping, unless you made an agreement with cito beforehand, but that is a relatively very cheap lesson learned.

Both of you need to start thinking clearly and step up. Otherwise I doubt either one of you will ever be able to do business in here again.

Tons of easy solutions in this thread. BigPete, just send the skis back, keep confirmation, eat the shipping, fire your lawyer who is likely charging you decuple the shipping costs, and forget about Cito.

If Cito refuses delivery, he looks like a schmuck in Court (laughable that this would get that far). If he accepts and then continues to pursue legal issues, his measure of damages would have to be some amount commensurate with a person being without skis for 3 months. And what the hell would that be?

To be clear, I am not taking sides on the merits (frankly, because neither party has provided much bolstering their positions), I am just speaking from a practical standpoint.

I was too bored at work and decided to read this thread... WOW, there are a lot of dumb people out there. The lack of reason and intelligence being spewed regarding this issue makes the thread almost too frustrating to qualify as entertaining.

If cito is actually being honest, I really feel bad for you dude. You have SERIOUS emotional problems. Sucks to get ripped off, but sucks even more to be socially inept.

Agreed price was $500 + shipping which came to $542 & change. Manhattan’s post offices are zoo like & took picture with my cell just to prove the hour plus long line. Pete said “sure man” ship from UPS.

Over 2 weeks go by, no payment, no problem. Months go by, problems. No matter what Pete says in any of his emails, I provided my paypal info since he claimed both his checks got lost in the mail. Now sorry, living in the same place for 7 years and not once having not received a single piece of expected mail is impossible to believe. Lets get real here. Then he only wants my bank account to wire money, now I’m getting pissed off and suspicious – why not just paypal then?

He said he would pay me $400 for both skis, now over 2 months later mind you. I said fu & piece of shit now make it $600 instead – out of pissness because he lowered the price by $150 and had all leverage since he had my goods. Last time we spoke thru PM I said just pay me the agreed upon $542 (including shipping) & end this. Even though now its after season & I could get less now & could have bought skis that I wanted in the meantime. I had to sell my praxis because of this scum and I wouldn’t sell them more then I got them for ($399). Also in the meantime he’s buying and selling skis - so he has the money. That didn’t sit well with me.

That’s where it currently stands. Believe who you want, but those are the facts and bottom line, I still have nothing for entrusting a tgr member.

sounds legit enough - throw up an attachment showing an email proving the agreed upon price and then it's up to bigpetey to pay it - controversy OVER.

well its kind of hard to pay someone, when they never "received the check". Than when i just want to straight deposit it in your bank account to get it over with, you say no, and when i say ok whats your paypal you decided to up the price.

you and i both know martin, that you were trying to milk me for a higher price,
you even told me to send back the ski's hoping that i had used them for that 1 month period, and when i told you i hadn't used them you said oh nm and not to send the ski's back. than you tried to threaten me by telling me you were going to sue me if i didn't pay you 600. bs guy

SOLUTION:

1. Cito posts his paypal address here, in this thread (using crazy spaces or whatever so spam bots don't get it). Now we all know petey has it.

2. Petey sends Cito $542 by paypal, and posts the confirmation email here. Now we all know he paid him.

The price we agreed on was 500, and second this guy emailed me information showing me that I was about to get sued. That being said, I have spent a good amount of money attorney fees, and I would rather have them take their chance in court to get back my money, and charge this guy with some more fees.

I have provided all the information I possibly can to them, and have been waiting for cito's paperwork that he said he sent out.
