    Your "attorney fees" don't mean dick and just prove WHAT A DUMB ASS YOU ARE for even seeking legal council over $542. IF you've spent a dime on fees that's YOUR mistake, next time wait until you've actually been filed on in small claims first.

    PAY CITO $500 for 2 pr of skis AND $42 for shipping them to YOUR DUMB ASS in the first place.


    And here's how the mail works dumbfuck, PUT a STAMP on it and an ADDRESS and it gets there. Damn near always. Check to see if your "lost" checks were cashed or did you put a stop payment on? You even have a checking acc.? Bullshit you sent a check TWICE and it didn't get there.

    petey, davep is on to something, you're just proving your own retardedness here. A little lesson for you: in court, if it comes out that you have his skis and didn't pay, no matter how much you can prove that cito was an asshat, you'll still owe him the price of the skis. Know something else? You won't get any of your attorney fees covered. In fact, you may have to pay his. It's really quite simple: pay or return. Neither of you would be remotely happy by going to court, even if it was small claims with no attorneys.

    I'm swinging back to cito on this one if you're admitting to holding on to the sticks and not paying a dime, never mind the fact that he's also an asshat.

    from what the attorneys said, i will probably be paying the for the ski's which i don't deny. But will get my attorneys cost back which is what I am just looking for.

    I already tried to pay this guy, checks, bank deposit, even paypal.

    its my mistake? when you see arushi law firm in your emails sent from this guy? its my mistake, when this guy tells you he comes from a big family of lawyers and is about to sue you. its my mistake, when this guy tells you to look up his name and hes dealt with the attorneys and federal court involved with millions of dollars in fraud.     i rather take my chances and protect myself and pay the attorney fees.

    in regards to your post about paying his fees.

    I was told all of this when I was being consulted. Its a chance I am willing to take, like I said I provided the attorneys with everything they have requested. emails, canceled checks, pm's.

    They seem ok and confident with everything, and in the end if he gets rewarded attorney and court cost, thats a different story.

    Is this fucking for real? You hired attorneys who in a mere two hours can cost more than the skis? Why not just send this guy a cheque via certified mail for the initial agreed price?

    don't you get it man this guy is a little crazy, i send out two checks they don't get return to me( he has them)...he tells me to return the ski's to him one min, than the next minute he tells me not to, than decides that he wants to sue me. i am thinking to my self this guy is really a nut case, he doesn't want his ski back he just wants to extort me for more money.

    what would have made him happy?.....i have no clue

    but i am going to stand up for what i believe in man.

    No, we get it. You're both fucking stupid. Fire the attorneys, learn a lesson, and pay for the fucking skis. Did he cash the checks? Why the fuck do you have to make this so fucking difficult? Pay the man what you fucking owe, and the both of you stop fucking whining about this idiotic bullshit on the internet. This is the easiest problem to resolve I think I've ever seen, and both of you want to do anything but make it better.

    Actually, I take it back. Keep the attorney, hell, hire a few others. You'll end up out the $542, and then out about $3000 or more in attorneys fees. You're both too fucking stupid to have this much money to waste.

    Fair enough. This sounds like a massive clusterfuck that wont be sorted out on the gear swap. Only advice is not to get in to deep of a hole with the attorneys. While they are out to serve your interest, like any other business, they are out to get paid.

    Also, is this guy really Martin Vitale? Even though he was convicted of embezzlement, I think you need to be competent enough to make a coherent post in a forum to become a CEO of a major grocery chain. This guy is full of shit.

    Petey - as a lawyer, I must say that the advice you are getting from your supposed lawyers is the stupidest advice I've ever heard. If those lawyers you've supposedly consulted were worth a grain of salt, they'd tell you to stop wasting your time with them and either PAY the fucking money or RETURN THE SKIS. Case closed, money saved, lesson learned. Don't those fuckwits have any better cases to work on than your stupid $500 ski case?

    Cito looked more and more retarded as this thread went on, but your true colors are beginning to show. Put a stop payment on the checks you supposedly sent and either paypal or return skis.

    Petey, That's a guaranteed method of self-destruction. I bought some Jester's from you, great transaction and no complaints. But when you start talking about trying to collect attorney fees when their hasn't even been a suit filed, and your dealing with not only different jurisdictions but different states, I get concerned whether our next transaction would be that smooth. That's really a crazy idea. As a special master (not an attorney) for the family courts in this part of Idaho, I hear demands for retribution, not justice, all the time. They get ignored. Just pay the amount, take the high road, look like the good guy, and keep on magging with those who appreciate that you did the right thing.

    In the US, "cancelled check" refers to a check that has been paid. In the old days before electronic banking, a bank would actually return the cancelled checks to you with the statement. Thus, if petey has a cancelled check, it would mean that cito deposited the check. Since both people seem to say that has not happened, I think petey is a delusional retard.

    When you "stop payment" on a check you get a receipt, I'm sure, but you don't have a check in hand, there is no cancelled check.
