The GORE-TEX® Brand Gnarliest Weather Photo Contest (the "Contest") begins on December 5, 2011 at 11:00 a.m. Eastern Standard Time ("EST") and ends on February 29, 2012, at 11:59 p.m. EST (the "Promotion Period"). By entering, users agree to these Official Rules of the Contest.
No purchase necessary to enter. Purchase will not improve chances of winning. Contest is open to all legal residents of the 50 United States and Washington D.C. who are at least eighteen (18) years old at time of entry, except employees of Sponsor(s), their affiliated companies, subsidiaries, dealers, sales representatives, distributors, advertising agencies, promotional and prize suppliers and the immediate families and household members of each. This Contest shall only be construed and evaluated according to applicable state and federal law. Void outside the fifty (50) United States and Washington D.C., and where prohibited.
To enter the Contest: You must register/sign up as a member at tetongravity.com. Go to tetongravity.com/contests/goretex-photo-contest and upload your photo. Only entries submitted following these directions will be considered for prizes. Online entries must be received before 11:59 P.M. EST on February 29, 2012. Entrants must share contact info and email addresses to enter. Multiple photos may be submitted, but each entrant is eligible to win no more than one prize. Photos must have a name and description (no.jpg extensions). Entrants may solicit votes for their photos, with only one vote allowed per person for each photo entry. Photo entries can accumulate votes from December 5, 2011 until February 29, 2012. Thereafter, the top twenty-five (25) photos ("Finalists") that have accumulated the most votes on Facebook as of February 29, 2012 at 11:59 p.m. will be reviewed on or about February 15, 2012 by a panel of judges made up of representatives of the Sponsor(s) to determine the four Winners. The 25 Finalists will be judged on composition, creativity, and originality. Judges' decisions are final. GORE-TEX® will be receiving entrants contact information.
The Grand Prize Winner for best overall photo will receive Patagonia Primo GORE-TEX® Jacket and Pants. Approximate retail value of Grand Prize is $900. Each runner-up (3 in total) will receive one of the prizes listed…(Burton AK GORE-TEX® Jacket goes to 1st runner up, Burton WINDSTOPPER® Hoodie to 2nd runner up and Burton AK Yeti GORE-TEX® Gloves to 3rd runner up). Total cumulative value of all prizes is $1,620. Any portion of a prize not accepted by Runners-up or Grand Prize Winner will be forfeited. All federal, state and local taxes are sole responsibility of Winners. Prizes may not be returned or exchanged for cash. Prizes may not be transferred or substituted except by Sponsor(s), who reserve the right to award a substitute prize (including cash prize) of equal or greater value.
Entrants must be the sole owners of the copyright of any photographs, images or multimedia they submit. Your submission is your guarantee that you are the author and copyright holder of the photographs, images or multimedia.
Subject restrictions: Entries must be digital images. Photos must have been taken within three (3) years before the date of entry. An image that combines the elements of more than one photograph or has elements removed is not eligible. Minor burning, dodging and/or color correction is acceptable. Photos must be appropriate for posting on a public website. Obscene, provocative or otherwise questionable content will not be considered. Sponsor(s) retain sole discretion as to what constitutes inappropriate content. Sponsor(s) reserve the right to remove and disqualify any photo entries containing inappropriate content.
Entrant represents and warrants that the submitted entry is an original, non-published work that does not infringe the rights or intellectual property claims of any third parties. By entering the contest, photographers agree to have their submitted photograph displayed on the tetongravity.com website without any fee or other form of compensation, and agree that tetongravity.com may display winning photos in a "past winners" photo gallery and in tetongravity.com email newsletters, and future contest promotions. Photos will be credited to the photographer named in the entry form. In the event that ownership of any photograph submitted to tetongravity.com is contested in any manner, tetongravity.com retains the discretion to disqualify that photograph and discontinue use of the photograph.
Photographs, in whole or in part, that, in Sponsors' sole judgment, are inappropriate, are noncompliant, or are in any other respect unsuitable (at the sole discretion of Sponsors) will not be considered. Sponsors reserve the right, at their sole and absolute discretion, to refuse, disqualify, or withdraw entries and/or entrants at any time during the contest. Ownership/use rights: Entrants retain the copyright to their photographs. By entering the contest, entrants agree that Sponsor(s) may use the photographs/digital images for promotional purposes, without further compensation. This may include publishing online or in print.
All entrants must have a valid email address at time of entry. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the email address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an email address by and Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Entry materials/data that have been tampered with or altered, or mass entries or entries generate by a script, macro or use of automated devices are void. The Sponsors are not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsors on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the contest. By participating in the contest, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Sponsors, which are final and binding in all matters relating to the contest. Failure to comply with these official rules may result in disqualification from the contest. Sponsors reserve the right to: (i) permanently disqualify from the contest any person it believes has intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impedes its ability to conduct the contest), and to select winner from among all eligible entries received prior to withdrawal.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, INCLUDING THE VOTING PROCESS, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR(S) RESERVE THE RIGHT TO PERMANENTLY DISQUALIFY FROM THE CONTEST ANY ENTRANT WHO EMPLOYS OR ENGAGES THE USE OF ARTIFICAL VOTING MECHANISMS OR OTHERWISE TAMPERS WITH THE VOTING PROCESS.
Odds of winning a prize depend on the total number of eligible entries received.
On or about February 15, 2012, Runners-up and Grand Prize Winner (hereinafter referred to individually and cumulatively as "Winner(s)") will be notified by Sponsor(s) using the e-mail address or phone number they provided with their entry. Prize must be claimed within 10 days. To claim a prize, Winner(s) must respond to the prize notification e-mail or phone call/message and may be required to provide proof of identity, address and birth date and/or execute an affidavit of eligibility, liability release and, except where prohibited by law, a publicity release. Prizes not claimed within fifteen days will be forfeited. Sponsor will select alternate Winner(s) for any unclaimed/forfeited prize(s) if a sufficient number of eligible and/or qualified entries remain. If an entrant changes his/her e-mail address or phone number after he/she enters the Contest, it is his/her sole responsibility to notify Sponsor by postal mailing notice to the address listed below to be received by the end of the Contest period. Winner(s) are solely responsible for all costs, incidentals, and any other expenses not specifically mentioned as being included in the Prize. All federal, state and local taxes, fees and surcharges on Prizes, if any, are the sole responsibility of Winner(s).
All entrants agree that Sponsor may, without permission or additional compensation, publish, display and otherwise use their name, likeness and submitted materials, if any, for promotional purposes.
Sponsor(s) shall not be responsible for: (1) misdirected, inaccurate, incomplete, lost, late, delayed, undelivered, damaged or illegible entries, and all such entries will be void; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; or (3) unauthorized human intervention in any part of the entry process or the Contest; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Contest or receipt or use or misuse of any prize. By entering the contest, entrant holds harmless Sponsor(s) and their parents, subsidiaries, operation divisions, and affiliates from any liability whatsoever for any claims, costs, injuries, losses, liability, actions, or damages of any kind or in connection with: (1) entering contest (2) acceptance of any prize or (3) anything related to the contest and the awarding of prizes.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor(s) in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of Delaware without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the state of Delaware.
